These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and Town's Post ("Company", "we", "us") governing your use of the Town's Post website at townspost.ca and all related services (collectively, the "Platform").
By creating an account or using our Platform, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Platform.
You must be at least 18 years of age to create an account or post listings on Town's Post. By using the Platform, you represent and warrant that you are 18 or older and have the legal capacity to enter into this agreement under the laws of Ontario, Canada.

Town's Post is a neutral online classifieds platform. We are not a party to any transaction between buyers and sellers. We do not:
All transactions are conducted entirely at your own risk. You are solely responsible for evaluating items and users before engaging in any transaction.
You agree not to post, list, transmit, or facilitate the sale of:

Violations may result in immediate content removal, account suspension, and/or referral to law enforcement authorities.
You retain ownership of content you post (listings, photos, descriptions). By posting on Town's Post, you grant us a non-exclusive, royalty-free, worldwide licence to display, reproduce, and promote your content for the purpose of operating the Platform.
You represent that you own or have the right to post all content you submit, and that such content does not infringe any third-party intellectual property rights.
We strongly recommend:
Town's Post offers optional paid promotional features (Featured Ads, Top Listings, Specialist Promotions). Payments are processed securely through Stripe Inc. By purchasing a paid feature, you agree to Stripe's terms and our refund policy.
Refund Policy: Promotional placements are non-refundable once activated, except in cases of technical failure on our end. Disputes regarding payment must be raised within 14 days of purchase.
Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. We comply with Canada's PIPEDA and CASL.
The Platform is provided on an "as is" and "as available" basis without warranty of any kind. To the maximum extent permitted by Ontario law, we disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or harmful components.
To the maximum extent permitted under the Ontario Consumer Protection Act (SO 2002, c. 30, Sch. A) and other applicable law, Town's Post and its directors, employees, and agents shall not be liable for:
Our total aggregate liability shall not exceed the amount you paid to Town's Post in the 12 months preceding the claim, or CAD $100, whichever is greater.
You agree to indemnify, defend, and hold harmless Town's Post, its officers, directors, employees, and agents from any claim, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Platform, your listings, your transactions, or your violation of these Terms.
The Platform may contain links to third-party websites. We are not responsible for the content, privacy practices, or terms of any third-party site. Access to third-party sites is at your own risk.
We reserve the right to modify these Terms at any time. Material changes will be communicated with at least 30 days' notice via email or prominent Platform notice. Continued use after the effective date constitutes acceptance.
We may suspend or terminate your account at any time for violation of these Terms, with or without notice, at our discretion.
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein, without regard to conflict of law principles.
Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada. You irrevocably submit to the personal jurisdiction of such courts.
Before initiating any legal proceeding, both parties agree to attempt to resolve disputes through good-faith negotiation for at least 30 days.
Nothing in these Terms is intended to limit any rights you may have under the Ontario Consumer Protection Act, 2002 or other applicable consumer protection legislation. If any provision of these Terms conflicts with applicable consumer protection law, the applicable law shall prevail.
If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be modified to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Town's Post regarding use of the Platform and supersede all prior agreements, representations, and understandings.
